2. Purpose
These Terms and Conditions of Sale (“T&Cs”) govern sales of products made through the website [www.maisondevienne.com] (“the Site”), operated by TAHITI EN SOIE SARL under the brand Maison Devienne.
Any order placed on the Site implies full and unconditional acceptance of these T&Cs by the customer (“the Customer”).
3. Products
The products offered are silk scarves in different formats (90 cm and 45 cm). Some models are offered in limited editions.
Each product is accompanied by a detailed description and photographs for presentation purposes only. Minor differences in colour or appearance may occur depending on the screen used.
4. Orders
Orders are placed exclusively via the Site.
The Customer undertakes to provide accurate and complete information, in particular contact details and delivery address.
Maison Devienne reserves the right to refuse or cancel any order in the event of an existing dispute, non-payment, or suspected fraud.
5. Prices
Prices displayed on the Site are in euros (€), inclusive of all taxes.
Delivery costs are indicated separately before validation of the order.
Products are invoiced at the price in force at the time the order is recorded.
6. Payment
Payment is due immediately upon ordering.
Accepted payment methods are credit card via Stripe and PayPal.
The order is considered final only after validation of payment by the banking institution.
7. Delivery
Products are shipped from French Polynesia.
Indicative delivery times are 5 to 10 business days for France and 10 to 15 business days for international orders.
These times may vary depending on carriers and customs formalities.
In the event of delay or loss attributable to the carrier, Maison Devienne cannot be held liable but will assist the Customer with any necessary steps.
8. Right of withdrawal and returns
8.1. Statutory withdrawal period and commercial extension
In accordance with consumer law, the Customer has a statutory right of withdrawal of 7 days from receipt of the order.
Maison Devienne extends this period to 30 calendar days for a return or exchange, subject to compliance with the conditions below.
8.2. Mandatory return conditions
The product must be returned new, unworn, unwashed and in its original packaging, including labels, leaflets and accessories where applicable.
It must show no damage, stains or odours (perfume, tobacco, humidity or any other foreign smell).
The product must be in a condition that allows it to be resold.
8.3. Prior examination and possible refusal
Before any refund, Maison Devienne examines the returned product.
If the return conditions are not met, the return may be refused and no refund will be issued.
The non-compliant parcel may be reshipped to the Customer upon request and at their expense.
8.4. Practical arrangements
Return shipping costs are borne by the Customer, except in the case of an error attributable to Maison Devienne.
Refunds are made within 14 days after receipt and validation of the returned product, via the same payment method used for the order.
To initiate a return, the Customer must contact support@maisondevienne.com, stating their order number.
9. Warranties
Maison Devienne products benefit from the statutory warranties: conformity guarantee (Articles L.217-4 et seq. of the French Consumer Code) and hidden defects guarantee (Articles 1641 et seq. of the French Civil Code).
In the event of a defect, the Customer should contact customer service at support@maisondevienne.com.
10. Liability
Maison Devienne shall not be held liable in case of improper use of the products.
It shall not be held responsible for indirect damages or delivery delays beyond its control, in particular those related to carriers or customs formalities.
11. Force majeure
Maison Devienne shall not be held liable for failure to perform its obligations in the event of force majeure as recognised by French case law, including natural disasters, armed conflict, strikes, health crises or transport blockages.
12. Data protection
Personal data collected in the context of sales are processed in accordance with the GDPR.
Consent management, privacy policy and cookies are handled via the Complianz plugin.
The Customer may consult the Privacy Policy available on the Site.
13. Governing law and jurisdiction
These T&Cs are subject to French law.
Any dispute shall be submitted to the competent French courts, without prejudice to the mandatory rights of the consumer residing in another European Union country.
